Terms of Service

Android Texter is a software platform that turns an Android phone into a programmable SMS gateway. The Service provides a web dashboard, REST API, webhooks, and related tools that allow you to send and receive SMS and MMS messages through Android device(s) you own and control.

Important architectural point: the Service does not route messages through a third-party SMS aggregator. Messages are sent from your own Android handset on your own carrier line. Your messages are person-to-person (P2P) traffic from the carrier's perspective.

You may use the Service only if:

• You are at least 18 years of age.
• You have the legal authority to enter into a binding agreement.
• You are not located in a jurisdiction where the Service is prohibited.
• You have not previously been banned from the Service.

You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activity that occurs under your account, including activity by anyone you grant access. Notify us immediately at [email protected] if you suspect unauthorized access.

You agree to provide accurate information when creating your account and to keep that information current.

When you send a message through the Service, that message originates from your own Android handset using your own SIM, your own phone number, and your own cellular plan. You — not Android Texter — are the legal originator of every message.

This has several practical consequences:

• All applicable laws governing SMS communications apply to you as the sender. This includes the US Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state-level consumer protection laws, and any equivalent laws in your jurisdiction.
• You must have prior express consent from each recipient before sending non-emergency marketing or informational messages to wireless numbers (TCPA, 47 U.S.C. § 227(b)).
• You must honor opt-out requests immediately. The Service automatically suppresses outbound messages to numbers that have replied with STOP, UNSUBSCRIBE, CANCEL, END, or QUIT, but you remain legally responsible for honoring opt-outs received through any channel.
• Your carrier's acceptable-use policy applies. Excessive volume, spam complaints, or fraudulent activity may result in your carrier blocking, throttling, or terminating your line — Android Texter has no control over carrier-level enforcement.

You agree NOT to use the Service to:

• Send messages without the recipient's prior express consent where required by law.
• Send unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Send phishing, malware, or fraudulent messages of any kind.
• Send unsolicited bulk messages (spam).
• Interfere with or disrupt the Service, the networks connected to the Service, or any other user's account.
• Attempt to gain unauthorized access to any portion of the Service or any related systems or networks.
• Use the Service to violate the laws of your jurisdiction or the jurisdiction of any recipient.
• Use the Service to circumvent carrier filtering for messages that would not be lawful if sent through a permitted channel.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

Some features of the Service require a paid subscription. By subscribing, you authorize us (through our payment processor, Stripe) to charge the recurring fee to your designated payment method at the start of each billing period.

You may cancel your subscription at any time from the Billing page in your account settings. Cancellation takes effect at the end of the current billing period; you will retain paid features until that date and will not be charged again.

Fees are non-refundable except as required by law. We do not offer pro-rated refunds for partial billing periods.

We may change pricing with at least 30 days advance notice via email or in-app notice. Pricing changes take effect at your next billing cycle.

The Service includes a REST API and webhook delivery system. You agree to:

• Respect documented rate limits.
• Use API keys only from server-side code or trusted environments — never embed API keys in client-side JavaScript, mobile apps, or any context where end users can extract them.
• Not attempt to reverse-engineer or probe undocumented API endpoints for security weaknesses.
• Promptly rotate any API key you suspect has been compromised.

The Service, including all software, design, text, graphics, logos, and code, is owned by Android Texter and protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose subject to these Terms.

You retain all rights to the message content you send and receive. By using the Service, you grant us a limited license to process, store, and transmit that content as necessary to provide the Service.

Our Privacy Policy describes how we collect, use, and protect your information. By using the Service you also agree to the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that messages will be delivered. Message delivery depends on factors outside our control including your carrier's network, the recipient's carrier, the recipient's device state, and applicable filtering by carriers and intermediate parties.

We are not a common carrier. We do not represent that any specific message is compliant with the TCPA, CAN-SPAM, or any other applicable law — that compliance is your responsibility.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDROID TEXTER AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

You agree to indemnify and hold Android Texter harmless from any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or the rights of a third party, including but not limited to TCPA and CAN-SPAM claims arising from messages you send through the Service.

You may close your account at any time by emailing [email protected] or via the account settings page.

We may suspend or terminate your account immediately, without prior notice or liability, for any reason including (without limitation) breach of these Terms, suspected fraud or abuse, or extended inactivity (see Privacy Policy § 6 for our inactive-account policy).

Sections 4, 5, 8, 10, 11, 12, and 14 survive termination.

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement.

You agree that any claims will be brought in your individual capacity, not as a plaintiff or class member in any class or representative proceeding.

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Material changes will additionally be sent via email to users with marketing consent and posted in the dashboard. Continued use of the Service after changes take effect constitutes your acceptance of the modified Terms.
